Tic Tac Toe itself is not banned because it is not a game of chance, but if you start using it to bet in a way that is malicious then you are risking your account and we may ask you to stop. While games of skill were not banned, the idea was not for people to come up with the simplest game they could use to earn cubits. It was to allow room for things like cool adventures, parkours, build contests etc... where entry fees made sense. So play it if you think it's fun, but I would discourage you using it to sidestep the rules with a technicality. Any game could be deemed malicious on a case by case basis if it's being played that way.
